5. PROPERTY REVIEWS, INSPECTIONS AND OBSERVATIONS
Unless specifically stated otherwise in a written agreement, property reviews, site visits, Home Protection Reviews, walk-throughs, photographic reviews, roof reviews, moisture observations, drone documentation, or other assessments performed by Garza R&R are limited to the agreed scope and reasonably observable conditions at the time of the review.
These services should not automatically be interpreted as:
- A comprehensive home inspection.
- A structural-engineering inspection.
- A code-compliance inspection.
- An architectural inspection.
- An environmental assessment.
- Mold testing.
- Mold-remediation clearance.
- Asbestos testing.
- Lead testing.
- Indoor-air-quality testing.
- Geological testing.
- Geotechnical analysis.
- Electrical-system certification.
- Plumbing-system certification.
- HVAC certification.
- Insurance-policy interpretation.
- A guarantee that every existing or concealed defect has been identified.
Many building defects are concealed within walls, roofs, flooring systems, foundations, ceilings, framing, or other construction assemblies. Certain conditions cannot reasonably be identified without destructive testing, demolition, specialized equipment, laboratory testing, engineering, or evaluation by another qualified professional.
Garza R&R may recommend additional evaluation by an engineer, architect, environmental professional, specialty contractor, building official, manufacturer, insurance professional, or other qualified party when appropriate.
6. MOISTURE AND WATER-INTRUSION CONDITIONS
Water intrusion and moisture-related conditions may be complex and may originate from more than one source. Observations or moisture readings taken during a property review represent conditions observed at the time and location of testing.
They are not necessarily a guarantee that:
- All moisture has been located.
- All water-entry points have been identified.
- Concealed damage does not exist.
- Future leakage will not occur.
- Microbial growth is absent.
Garza R&R may recommend further investigation, drying, demolition, testing, remediation, or evaluation by qualified specialists when conditions warrant.
7. ROOFING, STORM DAMAGE AND INSURANCE MATTERS
Garza R&R may document roof conditions, storm-related conditions, impact damage, water intrusion, repairs, restoration needs, and related construction conditions.
Garza R&R does not determine whether an insurance policy provides coverage and does not control whether an insurance carrier approves or pays a claim.
Unless separately authorized and legally qualified to provide such services, Garza R&R does not:
- Interpret insurance-policy coverage on behalf of policyholders.
- Determine claim coverage.
- Settle insurance claims.
- Negotiate insurance coverage as a public adjuster.
- Determine the amount legally owed by an insurance carrier.
Insurance-coverage decisions remain the responsibility of the insurance carrier, policyholder, adjuster, and other appropriately licensed professionals. Construction recommendations, photographs, scopes, estimates, or documentation provided by Garza R&R do not guarantee that an insurance carrier will approve or pay for any particular repair, replacement, or service.
8. EMERGENCY AND TEMPORARY SERVICES
Garza R&R may provide or coordinate emergency or temporary property-protection services when available. Examples may include:
- Emergency tarping.
- Temporary waterproofing.
- Board-up.
- Temporary covering.
- Temporary stabilization.
- Water-entry mitigation.
Submitting an emergency request does not guarantee immediate response, availability, or dispatch. Temporary measures are intended to help reduce further exposure or damage and should not be considered permanent repairs unless expressly stated in writing.
If conditions present an immediate danger involving fire, electrical hazards, structural collapse, medical emergency, or threat to life or safety, contact the appropriate emergency authorities.
9. CONTRACTORS, SUBCONTRACTORS AND SPECIALTY PROFESSIONALS
Garza R&R may utilize or coordinate contractors, subcontractors, suppliers, vendors, consultants, engineers, architects, designers, inspectors, or other professionals as appropriate for a project.
Certain work may require an appropriately licensed, registered, certified, or otherwise qualified trade or professional. Nothing contained on this website should be interpreted as a representation that Garza R&R personally performs every specialty service associated with a project. Website use does not establish payment terms. Deposits, progress payments, final payments, financing arrangements, allowances, change orders, cancellation rights, late-payment provisions, and other financial terms are governed by the applicable project agreement and applicable law.

24. GOVERNING LAW
These Website Terms are governed by the laws of the State of Tennessee, except where federal law or another applicable non-waivable law controls. To the extent permitted by law, disputes relating solely to website use will be handled in an appropriate state or federal court having jurisdiction in or serving Hamilton County, Tennessee. Nothing in this provision eliminates rights that applicable law does not allow the parties to waive.
25. PROJECT-RELATED DISPUTES
Disputes regarding actual construction or project services—including scope, workmanship, payment, delays, materials, warranties, changes, property damage, or project performance—are governed primarily by the applicable project agreement and applicable law. These Website Terms are not intended to replace the dispute-resolution provisions of a signed project agreement.
26. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect. Any invalid or unenforceable provision will be interpreted or limited to the maximum extent permitted by law.
27. NO WAIVER
Failure by Garza R&R to enforce a provision of these Terms on one occasion does not waive its right to enforce that provision or another provision in the future.
28. CHANGES TO THESE TERMS
